Terms of Service for Aliquot

Please read these Terms of Service ("Terms") carefully before using Aliquot ("the App") provided by Jerry Situ ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What Aliquot is

Aliquot is a personal logbook. It lets you record notes, doses, vials, protocols, and measurements that you enter yourself. Aliquot does not provide medical advice. Aliquot is not a medical device. Aliquot does not recommend doses, protocols, vendors, or substances. Aliquot does not diagnose, treat, cure, mitigate, or prevent any disease or condition. Aliquot is a neutral tool for your own reference.

2. What Aliquot is not (please read carefully)

Aliquot is not a substitute for a licensed medical professional. If you are considering using any substance, prescribed or otherwise, you should consult a qualified healthcare provider who knows your medical history.

Aliquot does not verify the identity, quality, purity, potency, sterility, safety, or legality of any substance you choose to log. Aliquot has no way of knowing what is actually in a vial. Published independent analyses of non-pharmaceutical-grade peptide products have found purity as low as 7.7% of labeled content. The existence of a logging interface is not an endorsement of any substance, any vendor, or any protocol.

Aliquot does not source, ship, broker, or facilitate the sale of any substance. Aliquot does not contain links to vendors, recommendations for vendors, reviews of vendors, or affiliate relationships with vendors. Any impression that Aliquot endorses or facilitates access to any substance is incorrect.

Aliquot makes no claims about any therapeutic, wellness, or cosmetic benefit. No feature of Aliquot has been evaluated by the U.S. Food and Drug Administration or any comparable regulator in any other jurisdiction. No feature of Aliquot is intended to diagnose, treat, cure, or prevent any disease.

IF YOU THINK YOU ARE HAVING A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR EMERGENCY SERVICES IMMEDIATELY. ALIQUOT HAS NO WAY TO DETECT OR RESPOND TO A MEDICAL EMERGENCY.

THE PHARMACOKINETIC CURVES, CORRELATION SUGGESTIONS, AND OTHER VISUALIZATIONS IN ALIQUOT ARE MATHEMATICAL MODELS BASED ON GENERIC PUBLISHED LITERATURE. THEY ARE NOT PERSONALIZED PREDICTIONS. ACTUAL ABSORPTION, DISTRIBUTION, METABOLISM, AND EXCRETION VARY PER INDIVIDUAL AND DEPEND ON FACTORS ALIQUOT CANNOT KNOW, INCLUDING (BUT NOT LIMITED TO) THE ACTUAL COMPOSITION OF WHAT YOU ARE PUTTING INTO YOUR BODY, WHICH ALIQUOT HAS NO WAY TO VERIFY.

5. Research substances and unapproved compounds

Aliquot may be used to log substances that are not approved by the U.S. Food and Drug Administration, the European Medicines Agency, or any other regulator for any indication. The existence of a field for such a substance is not an endorsement of its safety, efficacy, legality, or purity.

You acknowledge that substances obtained from sources other than licensed pharmacies may contain impurities, contaminants, incorrect potencies, incorrect compounds, or nothing at all. You accept all risk associated with your use of any such substance. You agree that Jerry Situ is not responsible for any harm, injury, illness, or death arising from any substance you choose to use.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Aliquot on Apple devices you own or control, subject to these Terms and the Apple Licensed Application End User License Agreement.

7. Subscriptions and purchases

7.1 Pricing

Aliquot is free to download. Aliquot Pro unlocks additional features and is available as:

Prices shown are in U.S. dollars. Prices in other currencies are determined by Apple's App Store pricing matrix for your region and may differ.

7.2 Billing

All purchases are handled by Apple through the App Store. Your Apple ID account will be charged at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions at any time in Settings → Apple ID → Subscriptions on your device.

7.3 Free trials

The annual subscription is offered with a 7-day free trial for eligible new subscribers, as determined by Apple. The trial automatically converts to a paid annual subscription at the end of the trial period unless cancelled before the trial ends. Trial eligibility is one per Apple ID per subscription group.

7.4 Refunds

All purchases are processed through Apple. Refund requests must be submitted to Apple through https://reportaproblem.apple.com. Jerry Situ cannot process refunds directly.

7.5 Price changes

We may change the price of subscriptions or one-time purchases. Existing subscribers will be notified in advance per Apple's policies. Price changes do not affect the current billing period of an active subscription.

8. Intellectual property

Aliquot, including its design, code, features, content, and brand, is owned by Jerry Situ and protected by copyright, trademark, and other intellectual property laws. All trademarks, service marks, and trade names used in the App are the property of Jerry Situ or their respective owners.

You retain ownership of any data you enter into Aliquot. By using the App, you grant us a limited license to store and process your data on your device and, if you opt in, through your own iCloud account, solely for the purpose of providing the service. We do not use your data for any other purpose and we do not have access to it.

9. Termination

We may suspend or terminate your license to use Aliquot at any time, with or without cause, with or without notice, if we believe you are in material violation of these Terms. You may terminate your license at any time by deleting the App and, if applicable, cancelling your subscription.

ALIQUOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS. WE DO NOT WARRANT THAT DATA WILL NOT BE LOST.

WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT THE APP IS SUITABLE FOR ANY MEDICAL, CLINICAL, DIAGNOSTIC, THERAPEUTIC, OR PHARMACOLOGICAL PURPOSE. ALIQUOT IS A LOGBOOK. IT IS NOT A MEDICAL DEVICE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JERRY SITU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF ALIQUOT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50 USD).

YOU AGREE THAT THE LIMITATIONS IN THIS SECTION ARE REASONABLE GIVEN THE NATURE OF THE APP (A LOGBOOK), THE PRICE OF THE APP, AND THE FACT THAT ALIQUOT HAS NO WAY TO INFLUENCE, CONTROL, OR VERIFY WHAT YOU CHOOSE TO DO OUTSIDE THE APP.

You agree to indemnify, defend, and hold harmless Jerry Situ and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

13. Governing law and dispute resolution

These Terms are governed by the laws of British Columbia, Canada, without regard to its conflict of law principles. Any dispute arising from these Terms or the use of Aliquot shall be resolved by binding arbitration in Vancouver, British Columbia, conducted in English, per the rules of the Vancouver International Arbitration Centre. You waive the right to a jury trial and the right to participate in a class action lawsuit against Jerry Situ.

If any part of this Section is held unenforceable, the rest of the Section remains in effect.

14. Apple-specific terms

You and Jerry Situ acknowledge that these Terms are between you and Jerry Situ only, and not with Apple. Jerry Situ is solely responsible for Aliquot and its content. Apple has no obligation to furnish any maintenance or support services in connection with the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the App, and Apple will have no other warranty obligation. Apple is not responsible for addressing any of your claims relating to the App, including product liability claims, consumer protection claims, or any claim that the App fails to conform to any legal or regulatory requirement. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, with the right to enforce them against you.

15. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date above. For material changes, we will notify you in the App before the changes take effect. Continued use of Aliquot after changes take effect constitutes acceptance of the revised Terms.
